Thoughts for the School Board Meeting 4/20/10

Anti-violence
I gave a version of these quickly to the Board on 4/20/2010 -- 3 minutes is definitely not enough time when district staff and requested speakers have no limit and public comments can be VERY LATE on the agenda making it hard for normal people (those with school age kids) to participate.  Thankfully this meeting for us was shorter.
  • Glad to report things have calmed down for my family.  It appears at least for the moment the message was received by the youth involved.
  • To be clear the attacks this school year (there were 8 + 2 more after the attempted beating) were legally physical assaults that came only after years of bullying on school property that finally bled online and into the community – but the issues were all playground / passing period based. To only call them bullying, especially the events of the last year, since the district's removal of the safety officer is to degrade/downplay the seriousness.
  • While I have not had time to closely review the new policies I’m sure they are approaching 90-95% of what is needed up from about 75-80% but the issue has always been more a problem with procedures and practices – reporting, investigation, tracking, cross site/student issues and effective interventions. This is then further hampered by a lack of serious focus on school safety as REAL issue for the district.  If I need to be the squeaky wheel -- I've now accepted that.
  • The bias is still to protect and treat each case/incident individually -- all school district staff had the EXACT same position on this at the last board meeting. This attitude diverges from the written policy, which should be the basis for guidelines to be drawn with discretion being allowed but requiring documentation when that discretion/mitigating circumstances are used to deviate from the guideline.  These exceptions could then be reviewed (possibly by a committee, Ombudsman or AUSD School Board in private session) vs. every incident.
  • Kids need limits and consequences – treating each incident uniquely every time leads to significant inequalities and potentially civil rights violations.
  • I firmly support the idea of a Detention Classroom or School with linked in services to social workers, counselors and teachers trained to assess kids for special education needs. Part of the funding might be found in the allotment the district does not receive because of at home detentions.
  • Efforts of supporting tolerance, diversity and anti-bullying that are currently being done and so wonderfully talked about last board meeting are insufficient, incomplete and likely completely ineffective. Outside of the freshmen class – every student I spoke with since the last meeting called them a joke from the lunchtime diversity events being the most ridiculed. They may make people feel better -- but only the adults.  Whatever programs are put in place they need VERIFIABLE data collected before, just after training and then again in a few months/end of the year to see if there was any impact.
  • When issues arise they must be dealt with immediately and in a “Teachable Moment” type approach. Stop things, explain how serious it is, explain the golden rule (would you want this type of thing done to you or your friend?), ask kids to reflect, allow them to ask questions, comment and dialogue and then move on. The adult needs to have a very serious tone vs. playing it off as a joke or kids being kids.
  • Lack of a racially / culturally diverse workforce including teachers and administrators makes situations EXTREMELY problematic for the district. The district really needs to work with a recruiter to find qualified candidates from all racial and ethnic backgrounds to better reflect the community and student body specifically in frontline teaching positions.

Special Education
I was unable to deliver these at tonight’s meeting but below are my opinions based on mine and other parents experiences with the district over the last 4-5 years at least as things have gotten worse.
  • The centralization of Special Education case management and control at the district level vs. each principal having a say on staffing and focus has lead to many problems and a lack of accountability for district level staff and the teachers & para-educators they hire and manage.
  • Special Education within the district now appears to be being treated as a cost center to be reduced with less and less concern to the law (and related rights) or the child’s needs and how that impacts the child, their classroom and the teachers.
  • Not enough time is spent even in Triennials to actually diagnose underlying conditions and disabilities and then come up with sufficient goals to address performance gaps before they become permanent. District counseling/testing staff are not present at every IEP meeting and requests for testing are ignored or tabled. Give me the data has become my mantra -- it should be the districts. But having the data means the district may have to outlay more resources to meet the undiagnosed needs.
  • There are a few key years/transitions that need to be handled with increased attention -- possibly K, 5, 8 are the key years to make sure that a student is prepared to advance. To me this would be a set series of at least 3 IEP meetings (1 month into the school year, half way through the school year and 1 month before the end of the school year). This would allow for the transition to be planned, ensure kids are on track to be promoted to the next grade and services are allotted for the following year and school site.
  • Special Education has moved from high quality early interventions to follow the "Oakland model" which is what is the bare minimum required and do not help parents navigate the system to get the services their child needs or should be offered without the need of “magic words.” This certainly reduces your special education budget over time but does not serve the student, fellow classmates or the teachers.
  • The district has lost the I for Individual in IEP. At the middle school they track the special education caseloads into certain courses and teachers often to the lowest common denominator of other special education students. I hear the word "No" so often even when there are specific and quantifiable deficits including official district benchmarks not being met. In those cases additional services to ensure a student's academic success is required.
  • I have been told D's and F's are ok for special education students -- that it is a matter of motivation and that the child does not fit into the Albany mold then they can't ensure success.
  • There is a lack of teacher interaction at the middle school -- specifically to attend meetings and work effectively with the Special Services case manager. This includes the need for all general education teachers to cancel other appointments so that they can be both physically and mentally present for all IEP meetings. If teachers need to be reimbursed for lost income or someone else needs to step in to help in their other duties -- that needs to be covered by the district.
  • There is need to focus on general education teacher training to review the IEP laws, accommodations, rules and compliance with rights like Least Restrictive Learning Environment.
  • I have been personally told by a teacher that they have a case load of over 100 different students a day and that they can only provide my son 1% of their time and attention.  We need to look at the overall number of students a teacher is managing and reduce that as much as possible.
  • The district has apparently moved against teachers and some are afraid to speak their mind freely in IEP meetings in regards to services they think a child needs this includes having to check in with the district personnel before and after scheduled IEP meetings for "feedback." My understanding is that this pre-meeting and provision of services is not allowed under the due process rules.
  • Based on my conversations with other parents, it appears that district staff have moved systematically on several cases in a coordinated fashion to reduce services that children were receiving and which would then allow them to eliminate positions or programs at school sites for next year.

Mass. Schools did not follow expert advice to improve PROCEDURES before suicide

"Authorities say she endured months of verbal assaults and threats, mostly in school and in person, although some of the bullying occurred on Facebook and in other electronic forms."

"'Nevertheless, the actions — or inactions — of some adults at the school are troublesome,' she said."

Much like my son's issues POLICY may be 80% in place but completey ineffective since PROCEDURES are not standardized and followed especially in one school or across multiple school sites.  I think we need to have a very strong look at existing policy and the minimum requirements of the various laws.  Then we need to discuss what additional policy & programs are needed to be put into place to supplement the minimum and truly make sure we are addressing the problems and then finally PROCEDURES need to be written, followed and disclosed to all the right parties.

This includes written document explaining what the district has done/not done and the rights & responsibilites of the parent/child for both the initiator and the target of an attack.

Those PROCEDURES need to include working with county & state resources on Mental Health, Special Education and Berhavioral Assessments, Safe Schools as well as when, how and to what level of cooperation will the district work with the Police, Sheriff and other law enforcement.

Thoughts on MA tragedy & Facebook Failings & Ideas for Protecting Your Kids

A few people have written tonight about the latest bullying tragedy. So I wanted to share my thoughts on the recent suicide and criminal charges out of Massachusetts for cyberbullying that turned to rape and violence and suicide.

Working in games / entertainment & social media/convergence field I've been dealing with online fans and communities since before the Internet. I am a very strong civil libertarian by nature but balanced by my belief in reasonable laws and limits applied fairly. I'm committed to communities/tribes self organizing and creating their own ground rules as long as they meet the lowest limit set by the law.

The problem of cyberbullying generally speaking is that it is now a stage in the overall bullying process and I've seen the media and our own district personnel miss that fact and only want to say we can't control it / do anything so we must ban access to the digital square.  It is very true that online word spreads at the speed of light and that people can say things they might not say in person if they saw someone's face -- but in reality these kids have already said those exact same things in person or to a friend in the real world specifically at school.  It is only wishful thinking to say that the internet/Facebook is to blame.

Deleting an account of a kid who was targeted can cause significant problems in collecting evidence.  If you need to / want to keep your child from seeing what is being said -- change the password.  Also be careful about un-friend-ing or blocking people on their account as then you may not have easy access to the piece of content in question that needs reported.

Using Facebook to find friends and things in common with people is the future to the "Bowling Alone" problem. As kids move from one school to another or have entirely new schedule/friends every grading period -- access to learn about each other and chat online helps prevent social isolation.  The problem is that it is proven in psychological testing --  the more people you put together in a space the less likely if they see a problem to speak up or help someone in need this is unfortunately true in the real world as well as online.  There are not enough Good Samaritans.

From what I can tell, the bullying starts in school with teasing, unaddressed it becomes intimidation, then hate and callousness this then flows into the community, then online and then back into the schools and the community. Often the kids don't even remember what originally happend to make them dislike the other person as they just keep ticking off more and more things they don't like about the target.  To the point of entirely devaluing them from a human being worth understanding -- into the "other" not worthy to life, liberty and the pursuit of happiness. That "others" mere existence and happiness must be stamped out.

When it gets to that point you can only have SERIOUS intervention before it gets worse.  You also need to create an environment where teachers, parents and police seize upon those "teachable" moments and STOP EVERYTHING so a kid or a group of kids gets the message clearly what happened and how that was handled poorly and they must try and empathize with the target.  Its the "Love your neighbor as yourself" lesson.

I've actually talked to some media outlets on background about the fact that Facebook's reporting process has fallen behind all their other changes so you actually cannot easily report every piece of content and all the different content types or abuse in the apps. Their reporting instructions/systems are therefore out of date. Facebook keeps changing their page layouts and the report abuse system no longer works to report the many different content types. These changes do not allow 3rd parties like parents or schools who see some public piece of content to report it.  Plus after a user blocks an offending user -- they often can't even go back to access the proper spot to report abuse. This lack of simple working functionality for a company valued at $13billion is very bad.

There are some tips for parents and kids that they can do to protect themselves as the abusers often post threats and then delete them before they get into trouble/caught and lie about them. Many bullies had thought they had figured out they could just delete/hide threats and they'd disappear -- making reporting to the police harder as they need probable cause before Facebook would release information.

But if a user has Yahoo / GMail for their email and leaves the default "send an email notification" setting with Facebook then even if they delete that email from their inbox, it remains in their online trash and that will keep all the history of direct threats, inbox messages, wall posts, etc. with a trackable message id until a user dumps their trash manually. Anyone who posts a comment inside a thread and who has notifications turned on then gets further comments emailed to them so that content spiders out as well and multiple copies may exist in inboxes or trash cans.  All of this can then be used by the police in their supoena power to get the actual records of a users recent account activity.

Additionally, parents/kids can use the prints screen key and the "paint" program that comes in Microsoft Windows to capture shots and then cut and paste the other text from all the string of comments. That too can be provided to the police to meet the probable cause standard for them to get access to an accounts activity.  Mac users I am sure you can use the print option and then "Save as PDF" inside the Send to Printer Menu that pops up.  Know in both cases you may not capture all the information -- just the starting message/status update.  You should cut and paste all the relevant text into a document and then marry that to the graphic screenshot.

I was called today by the Chief to follow up and make sure I knew things were underway. I am happy to say publicly that yes they are now officially investigating the latest series of incidents and taking a long term view of the problems my son has faced in both the community and in school since moving to AMS for the start of 6th grade.

I do want to make it clear that parents should be reporting crimes directly to Albany PD and not hoping, waiting or expecting the school staff to do so.

I feel I have been misled by school staff on more than one occasion that matters had been forwarded on to the police when they had not. I have now been told by school district leadership that they only allow reports of the "required crimes" dealing with drugs, sex or weapons (knife & guns only). I think this is a VERY LOW standard especially in light of the lack of resources and qualified individuals the district has to devote to safety and investigations -- since the end of the School Safety Officer agreement with Albany Police.

I personally take safety, gang-like activity and general hooliganism pretty seriously. I like to have fun and joke around myself -- working in the video game and entertainment industry maybe kids can identify with that. However as a Christian, I have very strong/critical feelings on the issue of real violence or threats of violence. I am extremely clear with my children on what is fantasy and where it ends and where reality begins including people's feelings and personal rights. Appropriate conduct, understandable "kid/teen" misconduct and illegal conduct -- all of our children for their own safety need to know those lines & related consequences at home, in the community and in school.

Suspension School - Time in now...

Brainstorming out loud here...

I definitely think participation in sports programs needs to be tied to behavior as well not just grades.  I can tell you several students said they felt that the reason some kids are not disciplined is that they are on a sports team -- whether this is true or not it is a perception.  Similarly open campus is a privilege and not a right - it should be curtailed for students with behavior issues.

If AUSD had an in-district suspension school program at least for violence/multi-day suspension/repeatedly suspended kids -- the district would then not loose/forego state funds right?  That money could then go to actually pay for the running of the suspension school.

Work assignments could be communicated, kids could be evaluated for special education and other services that may have not been properly identified. Specialist teacher / school psychologist/counselor or non-profit partner agency could be based close by if not in/next to the room. Staff cost could be covered by replacement of lost income district forgoes to suspend and send home.

We could possibly have a special suspension school bus that picks up and drops off those kids so that they are safe/out of the hair of the other school they are suspended from. Free school lunch to keep all kids on campus and make sure that hunger/blood sugar is not a culprit.

If over time these kids could then not be successful in the general population -- they keep getting suspended, but were still trying -- then the next step would be to setup a separate permanent program and offer the choice of that or expulsion.  Unfortunately you need to be careful then of separate but unequal.

It just would not have to be more fun than a normal classroom/school experience that a troubled kid would want to go there -- my nephew is one of those serially troubled kids who'd probably rather be in the small class and get the extra attention vs. figuring out how to be successful in the traiditonal program

Room at District HQ or that other closed down elementary on Albany Hill that houses NSELPA Campus / MacGregor could possibly handle this...

Irony of BAD district policy

I found it very ironic that this last week Albany High School suspended a student for brining a bottle of soda pop on campus while they still have not suspended a group of children who threatened to kill, attempted to kidnap and beat my son.

Only after a warning and TWO MORE incidents did they suspend ONE student involved for 5 days and that was for disobeying a direct order by district staff to not return to the Middle School property during school hours.

This group of students through Friday morning continued their online threats, harassing phone calls with death threats, and then PUBLICLY using Facebook to organize a new attack planned for Friday afternoon on my son at/near AMS and planning/suggesting they would vandalize our family home &/or car. It has also been reported to our family that this group has continued to return to AMS daily in hopes of catching my son.

If ever there was a need to review the discipline procedures and priorities for the district the time in NOW. This includes violence, threats of violence and bullying -- written documentation by the students involved -- not just the adult, safety & discipline council to review cases, reporting internally to school board, possible need for independent ombudsman that reports directly to the school board & public, in-district suspension school so that going violent is not just a "vacation", referral to police for investigation, student run grievance/mediation process, community service/youth court, etc.

A friend of my son's was shot at this weekend in Oakland just walking down the street in front of his own home with a friend. He was in the wrong place at the wrong time.

Your child could be equally hit in "cross fire" of any kind when student discipline problems are left to fester because it is easier to ignore than it is to deal with the reality that we are living in an increasingly violent and uncivilized culture and that this reality reaches even our small community. Especially in the case of "Black-on-Black" crime when the youths involved are Albany born and bred but feel they must prove themselves to the "tougher" out of district kids so they focus on bullying down on special education students, immigrant children, children of LGBT families, etc.

Is the Answer to Close Middle Schools?

I just really wonder if the entire concept of the creation of Middle Schools
much like New Math or other "advances" in education or child development that
has done more harm than good and allowed situational problems to be
misidentified over time as people problems.

I also wonder if it is a part of the reason why parochial / religious K-8
schools seem to have better test scores with similar populations of kids in
certain communities -- even when class sizes are higher but number of students
in the overall program/number of unique students a teacher has all day is lower
than average. A teacher is in part a case manager for a students education --
throw more unique students on a teacher, more cases to manage and more
relationships to manage.

What I find funny as a child of the Catholic school system -- is that parents
were even less involved when they paid cash out of pocket because they had an
even further "market" based relationship with the school provider/teachers but
also then had a results based point of view.

On a personal level, I feel more and more certain that the number one thing we
should do to rescue education in the US is to close middle schools down and
create smaller Jr. Highs that are a part of the elementary schools but "schools
within a school" concept. It would mean transitioning one Middle School into an
Elementary and further dividing down the elementary population to free up
classrooms. It would mean that to create sports teams to compete at Middle
School level it would require "all district team" in the case of Albany.

If middle school is where parents are pushed out but simultaneously where
serious problems begin (performance gaps become permanent, kids who drop out in
HS tuned out in MS) -- keep the continuity of care from Elementary until High
School where kids are supposed to be more developmentally mature. I realize
there is a "we can't protect kids forever" and "social developmental skills
building is very different for middle school aged kids" type logic tossed around
-- however are those good enough reasons to not look seriously at this.

It is VERY clear to me that the transition from Elementary to Middle School is
very harsh & abrupt and that it creates too many situational problems/gaps that
then look like people problems. On a personal note, I think most Middle School
teachers are less friendly, less open more overwhelmed, less team oriented with
each other and with parents and a LOT less happy/satisfied than the Elementary
teachers I've dealt with.

Middle School has different rules, culture and bullying problems, mixing kids
together from multiple separate sites, lack of resources for supervision, lack
of resources for counseling, lack of communication/continuity of
issues/disconnection between elementary teachers and middle school to talk/share
individual student strategies, lack of communication/continuity between service
providers like special education, etc.

Anyone have the data on districts that have done this vs. setting up K-8
charter? Which is another alternative.

Onto El Cerrito

So one of the incidents occurred in El Cerrito which is another City and another County -- we just happen to live less than a block away from the dividing line. So I need to work with them to file one of the incident reports of the attempted theft and ongoing intimidation / harrassment. Luckily there are both adult witnesses to the initial threatening behavior and cameras that cover parts of the areas where the incident took place.

Some of the kids involved in continuing lunchtime harassment have thought they could run across city/county line and not be touched. This is not so and the El Cerrito police officer responsible is well aware of their past activities and patterns.

I want to be clear the incidents with my son have for more than a week risen to the level of repeated, premeditated crime. It was teasing, then bullying for multiple years and now it is flat out crime and "organized" almost entirely using Facebook, mobile phones, texts and emails -- both at school and at home.

As a Christian, I think everyone is given the opportunity to be saved but a penitent heart is required before reconciliation and salvation.

We can all say isn't it a shame that people end up and prison and more could have been done and miss the victim entirely. Both my mother and one of my sisters worked for years on educating prisoners and helping their families. However, both have clearly said to me -- there is a reason for prison and even working within the system for change -- there are definitely people who should be in there. I'm no fan of a California's prison system vs. education -- but interventions need to take place early and sometimes it takes being hit by the sword of justice to open offenders eyes to their choices/responsibilities so that they can be reformed.

I leave it up to the police and prosecutors with media scrutiny to decide where the lines are and unless there is some travesty -- I won't have to move forward with civil lawsuits on top of the restraining orders to get parents to control their children.

Raising a young black male who is growing up in the "urban" culture is challenging for a number of reasons - but when that child reaches about 13 years old they are no longer cute and this type of behavior if not stopped is a potential death sentence. I had Tupac volunteer with McCollum Youth Court earlier this year for his 8th grade service project to see what happens when kids start making the wrong choices.

Tonight, Tupac had multiple telephone death threats and further harassing calls that are now being traced by the police. There were additional veiled and not so veiled threats posted online almost simultaneously and the police responded properly to investigate these.

Unfortunately, it was reported to our family by multiple people that the AHS students involved in this continuing series of incidents were AGAIN on AMS school property Thursday afternoon defying school district orders that they are not to be there. Tupac was still recovering from an unrelated asthma attack so he was not in school on Thursday. These kids tried to enlist other AUSD students to be lookouts and to tell them where Tupac was so that they could attack him.

Tonight part of this core group has been using Facebook to organize another attack for tomorrow and vandalism at our home to further the intimidation. Other "nice" AMS and AHS students are cheering these kids on which only seems to increase their boldness. Luckily another growing group of students and their parents are now forwarding the illegal activity to the police department directly as well as contacting me.

I have not posted too many kid quotations directly on this site -- but know I and Tupac have both previously been targeted with Hate Speech and specific threats of violence even after the start of the police investigation. This afternoon / evening -- more threats

Tupac received multiple threats by phone tonight. We called the police, they came out and took the report and they will be running a trace. About the same time this same group of kids + one or two others posted comments to Facebook that were also being reported to the police.

The bullies are trying to scare him to say they will kill me -- his father. As he already has lost his birth parents, my partner and I have been hospitalized and recovering from a series of heart attacks in spring/summer 2008. This is a particularly cruel move/low blow. But Tupac remains resilient.

We have had other AMS students report back to us that two of the three main sponsors of violence including the one student who is currently on suspension were again on AMS property today this afternoon looking for Tupac to assault him and telling kids to inform them when/where he was so that they could "end him," "end this" and "kill him". As this is a violation to the school district personnel directive (which they supposedly have all been warned of) on top of the illegality of the menacing and threatening -- these kids just can't seem to keep digging themselves deeper and deeper.

For the students now reading this...

Tupac is very sick with an asthma attack today -- he's had it since birth. We are headed into the hospital but he will be fine. He generally misses 2-3 school days when it gets this bad before he recovers.

He is not hiding. He is not out of school because he has been bullied or threatened. He is genuinely sick and it is entirely unrelated to the other stuff.

As a kid, he had HUNDREDS of trips to the Dr.'s, surgeries, etc. His day-to-day health is significantly better but he will have asthma and his other problems forever and can only do his best to control them and avoid things from time to time that might make it worse.

My response to the AlbanySchools Moderators choice to remove my original message

We are headed to court tomorrow/Friday and these and more will be public records and technically youth are not protected other than at 18 they can have youth criminal records sealed for past behavior. Any reports in the media, their behavior online or in public are not protectable and they have no rights/demands to squelch hide -- in this internet age that is their punishment. These kids need to know that their behavior now will have consequences forever -- just like the psychological damage they are causing. Any further attacks after restraining orders are in place -- this group of kids will be charged as adults.

Please make your policy statement public so that people on the list know -- transparency is best in moderation.

On a personal level, I have been threatened by one child's parents who has broken my sons nose twice on school property -- they also similarly abuse & bully school staff which is one of the reasons why the school staff did not follow through on the policy! There is a reason why their kid is a bully. If any list moderator has been threatened by them now or in the future please make sure they know they should immediately call 911 and save any evidence, gather witness names.

Please know, I will attempt to repost that message with edits saying student 1, student 2, etc., a note that the original message was removed referring to your post on the removal with my disagreement but understanding. If you want any further edits to that before the repost -- have the moderators review and offer them back. This is too important a topic to have it completely silenced/erased.

I will make a statement in that re-post to let people know that putting the names public has allowed other parents to contact me, the district and now the police to report crimes and have conversations with their kids that has uncovered unreported bullying/crime. This has clearly helped show that there is a multi-year, multi-site, multi-kid pattern of escalating intimidation, bullying, threats and violence and expose the severity that several kids have received over time from a core group. It has also shown that the district has not dealt with these kids in a long term, comprehensive student discipline based view that could/should have resolved this matter under existing behavior rules before it escalated to repeated violent attacks.

I have also gathered the last 2 years worth of emails to the district where I have constantly asked for additional staff support, IEP meetings and a behavior plan that could protect my son and any other kid around my son because of "incidents." It shows a pattern of ignoring the problem, being out of compliance with federal and state laws, etc. The statement that "we never saw this coming" is incorrect, it is rather a we just did not listen to the kids and give any of it enough attention until some parent decided to go public -- thank God this was before a more serious event.

Since this latest event the bullying, threats and intimidation continue and in some ways are worse and seem to look like they will only get even worse as the police finally begin investigating this. I will leave it up to the police and prosecutors to decide what things they feel they can prove and move forward with as charges.

Once we get through this phase and things begin to settle down -- I am very interested in solutions / raising the bar for behavior between kids and giving all kids the tools & training to help stop bullying and increase the sense of community. Unfortunately, I don't think that is realistic until they see there are consequences and we go through a "truth & reconciliation" phase.

Met with Officer Belman, proceeding with restraining orders

I met with Officer Belman this afternoon to give him an overview of the case/where we are at. He begins his investigation tomorrow of the previous incidents involving at least three AHS students. Any new/further incidents will be 911 calls as soon as I hear of them.

Apparently unless a weapon is involved the school district will not report violence to the police. However my understanding is that the school district must enforce restraining orders and contact the police when they are violated.

Going to try and get temporary restraining orders tomorrow.

Suggested Police Presence near AMS during AHS open campus lunch and afterschool

I have asked and the suggestion is being forwarded onto Patrol Lt. Geissberger that for the time being it would be VERY helpful if the Albany Police station an officer and squad car near the AMS/bike/BART path area during AHS open campus lunch and again after school daily until the bulk of AHS students pass by to ensure that the children in the community understand this safety issue is being taken seriously.

TUESDAY, Mar. 9
AUTO BREAK-IN — During the day someone broke into a teacher's car that was parked at Ocean View School on the 1000 block of Jackson Street by smashing the window. There were no witnesses.
THEFT — Someone stole the rear license plate off a car parked on Pierce Street. There were no witnesses.

WEDNESDAY, Mar. 10
VIOLATION — At about 3:30 p.m. officers contacted two men who were going through garbage in the area of Stannage and Washington avenues and warned them that their activity was a violation.
DOMESTIC VIOLENCE — At about 5 p.m. officers responded to a residence on Evelyn Avenue on reports of hearing a loud bang noise then a woman screaming and yelling to call 911. They transported a 54-year-old Albany man to Kaiser Medical Center Richmond by ambulance. He was later arrested at the hospital for suspicion of domestic violence and making threats. He was later transported to North County Jail.

THURSDAY, Mar 11
ASSAULT — At about 7:45 a.m. officers responded to Albany Preschool on the 800 block of Masonic
Avenue on reports that a female employee had been attacked and injured by an assailant who was hiding in the school's bathroom when she arrived early to the school. The attacker is described as a white male adult, 30-40 years old, about 6 feet tall, with black or brown hair, a full beard and mustache and wearing Ray Ban type sunglasses. He was wearing a black and blue checkered and zippered hoodie with a three-inch square pattern. He reportedly sprayed a cleaning spray in her face, struck her and kicked
her, then stabbed her multiple times with a sharp, short bladed weapon, possibly a box cutter. He was gone when officers arrived. Officers are investigating.
SCAM WARNING — During the afternoon officers received several calls from residents on Ordway and Neilson streets reporting a suspicious call from someone saying they were from PG&E and wanting to come to the home to do the paperwork for a tax refund. They indicated needing to see their tax return and also needing a signature. When contacted, PG&E said they did not have a program like this.
DUI — At about 11:30 p.m. officers arrested a 25- year-old Pittsburg woman on San Pablo Avenue near Gilman Street for suspicion of two counts of DUI.

FRIDAY, Mar. 12
DUI — At about 3 a.m. officers stopped a vehicle on San Pablo Avenue near Page Street for a vehicle code violation. They arrested the driver, a 29-year-old Berkeley woman, on suspicion of two counts of DUI.
THEFT — At about noon a member of the Berkeley Fire Department reported observing a person d escribed as a black male adult, 28-29 years old, about 5 feet 9 inches tall, wearing a black hat, black pullover and black pants, take a bottle of tequila off
the shelf andleave without paying. Officers located the suspect, a 26-year-old San Leandro man, for suspicion of theft.
BREAK-IN — Someone broke into a residence on Thousand Oaks Boulevard through the garage and stole items from inside. There were no witnesses.
WARRANT — Officers arrested a 27-year-old Oakland man near Masonic Avenue and Garfield Street for an outstanding warrant shortly before midnight.
DRUGS — Officers arrested a 19-year-old transient woman on the 700 block of Masonic Avenue for suspicion of drug possession.

SATURDAY, Mar. 13
DUI — A few minutes after midnight officers arrested a 26-year-old Oakland man on the 1100 block of Solano Avenue for suspicion of two counts of DUI.
DUI — At about 2 a.m. officers arrested a 29-year- old Richmond woman near San Pablo Avenue and Buchanan Street for suspicion of DUI and reckless driving.
FIRE — Albany firefighters responded to the area of Masonic and Brighton avenues at about 3:30 p.m. on reports of a trashcan fire.
THEFT — At about 11 p.m. an employee at Albany Bowl on the 500 block of San Pablo Avenue reported that a group of adults and teens were told to leave the bar because they could not serve teenagers. When the group left they stole some of the bar glasses. They were gone when officers arrived.

SUNDAY, Mar. 14
n DUI — Officers stopped a vehicle on the Buchanan Street interchange at about 3 a.m. for a vehicle code violation. They arrested the driver, a 26-year-old Oakland man, for suspicion of two counts of DUI.
AUTO BREAK-IN — During the night thieves broke into a car parked on Stannage Avenue and stole the stereo from inside. There were no witnesses.
WARRANT — At about 8 p.m. officers arrested a 32- year-old El Sobrante man on the 500 block of San Pablo Avenue for an outstanding warrant.

MONDAY, Mar. 15
THEFT — A few minutes after midnight, a couple entered Café Raj on Solano Avenue and asked for food. When they were told that the restaurant was closed, they said the woman was pregnant and asked if she could the bathroom. When the employee stepped away, they took money from the cash register and departed. They were gone when officers arrived.
ASSAULT — Officers responded to Memorial Park on Portland Avenue at about 1 p.m. on reports from Public Works that a person was walking near the construction area with something that looked like a gun, but was later found to be a pipe. Officers arrested the 18-year-old Richmond man for suspicion of assault. A victim was found and transported to Kaiser Richmond.

Wednesay AM Update

I have had an email conversation with Officer Belman who previously was the school safety officer until Albany USD defunded the program last year.  He is going to begin the proper investigation of the crimes and threats. 

This communication occurred when another parent who had his email made the re-introduction.  He was the first responding officer on scene (arrived after I did) when the "Arranged Beating" occured -- he was able to see and witness the behavior of the "gang" of kids who reamined on school property and who would not respond to his or the school district personnels commands.  He is also the officer I had to demand walk my son and me to the car and I again went into detail how out of hand things had gotten but that this was a festering, longterm multi-kid problem.

We have worked with Officer Belman when my son was shot by another AMS student with an airsoft rifle in an ambush at our home and another incident that happened last school year.

To be clear this issue still has not been responded to by the Albany Police Chief or any officer he delegated -- no email, no phone call, no home visit -- despite being contacted by me multiple times -- and publicly shamed.  My understanding is that a parent may have heard about the "scheduled beating" before it was to occur last Tuesday and contacted the Albany Police and no one responded -- I have not been able to confirm that -- but if so that is incredibly troubling.

Officer Belman upon direct contact via email was the one who stepped up and said he would begin the investigation.  Since he has the most experience with kids and the population of kids this invovles that is as good a match as can be had.

At this point, other parents whose kids have been targeted with extreme cyberbullying, extreme bullying in school or violence/other crimes in the community should work with their kids to summarize the incident/s, develop a timeline and get a complete list of kids invovled & any witnesses -- and then contact Officer Belman directly.  There are different statues of limitations for different crimes -- but if you do the prep work with your kids, it will make this process easier on everyone involved.

Tuesday Update

My son was again attacked at AMS this morning before the start of his second period. He was on the blacktop playing basketball and not in the office where he volunteers during first period -- his choice/mistake to not be in the right place as has been discussed with me and the school.

The AHS student first yelled/initimidated from the bike path as he had done the previous day during open campus/lunch. My son said to go to his school and leave him alone and reminded this AHS student was not supposed to be on AMS property/harassing him. The AHS student then went onto AMS property and calling names and trying to start a fight. My son was headed to the office to report this as the AHS student was stalking him from 5-7 feet behind but closing fast all the while calling names/trying to provoke a fight. The AHS student then pushed him from behind and Tupac took his basketball and threw it at the student -- in his mind "defending himself" -- as the AHS student continued to threaten and push him as he continued to walk/run to get help from the office.

The AHS student was allowed to walk off AMS property without being told to stay. My understanding is that the police were not called but need to verify that as neither my son nor other witnesses have been interviewed by the police department. This incident should have been reported to the police as I have previously asked district personnel that any violence or threats involving my son REQUIRE immediate police reporting so that they can be investigated.

This is the 4th incident with this individual AHS student in less than 2 full months including an attempted theft/robbery that occured at El Cerrito Plaza on a Saturday.

Later this morning the Super. & the AHS Prinicpal met to handle the disciplinary issues with this specific AHS student and it is now being addressed under school policy. Which means home suspension -- leaving the student free to roam the community if his parents choose/are unable to supervise him.

The district beleives the other previous incidents require additional reseach and investigation and wanted to make it clear that was begining to happen. I have contacted the hospital to get all the records of previous attacks/ER visits as well as the Optrician to get all the records surrounding his special perscription glasses that have been broken during incidents which leave him legally blind.

This afternoon there meeting with Super. Marla, Nick B. of Special Education and the Principal and Vice-principal at AMS. They and I are all now mostly on the same page. We have a behavior plan in place that should provide adequate supervision during the school day and transportation plan that should help reduce the chance of a before/afterschool attack. Super. Marla said she is meeting with the Police Chief to get a handle on the overall safety issues and cooperation needed.

However as we left AMS after this meeting, Tupac was taunted by several kids and told that the student who has repeatedly threatened to kill him was closeby on the bikepath waiting to finish him off.

Albany Police still have not responded -- it has been a week.

Monday Afternoon Update

I was contacted by the Super. Marla again in the coversation it was obvious she had not read the complete document and that no investigation had begun. She said I would be contacted by the AMS principal and Special Education groups to schedule meetings. AMS principal and special ed both have followed up and we are trying to get those conversations scheduled.

In the mean time my son was again harassed / intimidated today by an AHS student involved in the incident last week and several previous incidents. This happened while on the Playground at AMS the student yelled and threated from the bike path that leads to El Cerrito Plaza. My son did not report this to me until after school and AMS staff was notified and said they will refer to AHS. I also left an additional message with the Super. stating this targeting continues without ANY provocation other than we are trying to hold the kids in question accountable for their actions.

However, still no response from Albany PD on the incident investigation.

Monday Morning Update

Apparently the district/principal of AHS sent out a note to the AHS e-Tree. My summary as a parent as I've had it forwarded to me is: "everything is 'FINE'" and "we must protect the privacy of those involved" this attitude is minimization, CYA and BS. In my sons's case., the AMS staff and Police could not initially disperse the group of kids waiting to jump Tupac the day of the latest event -- it took calling in a second officer and the staffer and police escorting us to our car (which I had to DEMAND) and while doing that telling the kids repeated and forcefully to go before they did leave -- but in minutes the exact same students were back on school property.

As far as the letter -- I guess there were other incidents this month involving AHS students -- students attacking each other with deadly force using a lead pipe. Another student begin robbed at gun point, hit over the head and requiring stitches.

I spoke with 5 kids and only 5 kids since last Wed about this issue. One was a former AMS/AHS student who left the district to attend Berkeley High after the bullying was too much. One was an AMS 8th grader who was attacked (punched, kicked, hit) on Cougar Field last school year by the same kids who have harassed my son for years. One was a student who has suffered from RELENTLESS attacks online and in-person intimidation by the same group of kids doing this same thing to Tupac. One was a student who is daily called "Terrorist" and "Sandnigger" at AMS. One was a student whose leg was injured when she was pushed down the stairs at AMS in 2010! My point is that this is 5 kids with 5 stories all of which felt the district & police response is inadequate.

There are other parents who have written me as well about their child or a friends child. Often saying they have been driven from the district. I've also heard (but yet to confirm) that there have been two suicides within the district that may have been in part do to social marginalization/bullying.

If your kids want to be driven to school -- ask why? Ask them if they've seen racist, sexist or homophobic name calling? Ask them what kids are marginalized and why (listening carefully to what words they refer to kids)? Ask your kids what is the line between teasing and bullying?

Since this LATEST event occurred I have not been officially contacted back by the district. I went over to the district office and demanded the uniform state complaint form for bullying. Super. Marla then appeared and we had a conversation she asked for evidence and summary. I provided that the next day. I have not been contacted back by the district. I also shared that EXACT information online as parents are very complacent (that can't be happening here) and blame the victim when it comes to school bullying and violence. I provided the same information to the Chief of Police and Mayor. I have not heard back from the Police Chief despite delivering evidence that should be investigated and move forward with prosecution.

This is a wider problem than the schools as events are bleeding out of the schools into the streets and out of internet into the schools and then into the streets. There is teasing, then there is bullying and then there is violence -- the cultural norm is that all are acceptable and underreported at AMS. If kids do report them in my opinion we don't have a sufficient handle on a system that works to resolve them and that complies with state and federal protections including criminal referral that is guaranteed to the victims.

So read the 30+ page document, read the kids actual threats, read the lack of school system or police response for just the incidents this year. I am not stripping out names but do understand the district's need for name privacy but they can and should talk about policy and if it is TRULY being enforced to at least the legally required minimum.

I won't let my son or other kids in the district go unprotected and allow the overall extreme low/lax social norms that have developed at AMS & AHS to continue which create a hostile environment for learning. I won't settle these issues by having the district settle it with just us privately/secretly and have the tax payers send my kid to a private school just because they think that is easier than the real work needed to fix the problems for every other kid.

It it tough enough to be a teenager -- we should not allow it to be daily hell.

            Being a child with special needs including anxiety, impulse control, sensory over stimulation and physically disabled – behavior management is even more difficult than a standard testosterone filled teenager.  However the system is still required to work for all children and ensure their safety and that is a two way street.  Those lucky enough to not have additional physical, mental, emotional challenges need to accept and live in community with those that suffer a more difficult path.  Similarly those who live with additional challenges need to be able to have a healthy and safe subculture and not victimize each other.  And though the consequences are not always the exact same kid-to-kid and situation-to-situation there are still ground rules and a culture of safety and inclusion rather than marginalization and exclusion.  However, safety comes first.

            Most of these issues seem to be after school, at lunch or passing between classes where students are least supervised and most willing to attack.

Overall Pattern
            Originally, Tupac generally does some small thing that is seen as a social slight or he is overly emotional at some everyday event.  Other kids see this and take offense.  They then continue to provoked / “wind up” Tupac so that they can then claim a “he said-she said” when it becomes violent. 

            Recently, a groups of kids who have done this for years – have decided since there was no real consequence to now initiate these events with no preceding action by Tupac other than their previous interaction/hate from before serving as the catalyst.

Pre-2009 School Year

6th grade
Malik Incident
Tupac accidentally bumped into Malik Parker during lunch time playing football on the AMS blacktop.  Malik then cursed and yelled at him for about 10 minutes to intimidated and belittle him.  No teacher or staff intervention while this happened.  Malik would physically be touching/on top of Tupac when yelling at him.  Tupac said repeatedly to “Leave me alone.”  After several minutes of Malik trying to get a response out of Tupac, Tupac pushed Malik away.  Mr. Neumann then came over and Tupac & Malik were both sent to the office.

7th grade
Kaylen Incident
Playing basketball on the blacktop at lunch, Tupac missed several shots and began to be teased by kids in 8th grade.  He did not respond directly. As this continued, when the other kids missed shots, he joked back.  Then “Kaylen” began pushing and saying, “Fight me, fight me.”  Tupac knew these kids were trying to get him into trouble.  After being pushed and called names non-stop for 5 minutes – Tupac pushed back.  Kaylen then punched Tupac and Tupac punched back.  A teacher intervened and just both kids to the office.

Doorway Passing Period Incident
Tupac was walking through the doors of the middle school and it was a particularly loud day, which he is very sensitive too.  He closed the door behind himself not know other kids were close by.  They took offense and Tupac was teased, pushed and then pushed back.  He was then punched and began defending himself.  He was then sent to the office and had to be taken to the emergency room.  Scuffle resulted in another pair of broken glasses.


2009-2010 School Year Incidents

1) “Cross Country Incident”

When:
Wednesday in September/October 2009
Approximately: 3:15-3:30PM (Wed Schedule – waiting for a teacher meeting to end for practice to start)

Where:
AMS blacktop near basketball court

Who:
            Tupac waiting for Cross Country practice to start
            Jidong was playing basketball nearby
            Malik Parker
            Malik’s friends (All African American)

What:
            Tupac was watching Jidong play basketball and waiting in uniform for Cross Country to begin, teachers were all in a meeting that day so it was not right after school.
            Malik and his friends approached Tupac without any words exchanged before this.  He immediately began slapping Tupac in the face and Tupac said “I’m not going to fight with you today.”  He continued to repeatedly slap Tupac in the face.  After about 15 total slaps – Tupac pushed him away.  Malik then punched him repeatedly in the face and in the stomach.  Tupac’s glasses were broken by this.  He went to cross country crying and after about 20 minutes he left practice to tell Mr. Neumann what had happened. 

Result:
  • Tupac needed to be taken to the Emergency Room
  • Glasses were broken/destroyed
  • Tupac’s glasses are a special prescription and take 4 weeks to get made at an out of state lab with a cost of $400+ each.  The actual lens prescription changes so often it is not affordable to keep an extra pair at this point.  He is functionally blind without the latest prescription.
  • When he does not have glasses he is forced to wear his sports goggles and that makes him a further target for teasing.

Tactic:
            These kids involved travel in a pack know they can physically intimidate other kids (specifically in the many-to-one situations) and especially when it comes to special needs kids – get them “charged up” so that they can then claim a “he said-she said.”  They also threaten / scare anyone else around from reporting these incidents.

School response:
  • Police were not called
  • AMS staff may have alerted AHS staff
  • Unsure if youth involved were suspended or not
  • Police were still not contacted even after parent request
  • No follow up with victim or parent as to the results of investigation or discipline
  • Tupac warned he cannot be on school property even if waiting for school or sports events.

Police response:
            Police officer said unless a report is made within X hours of an event then they are severely limited to what type of investigation and further prosecution the prosecutors will take.   They blamed the school for not reporting this.


2) “Airsoft Ambush”

When:
            Sunday before school returned after Winter Break.

Where:
            Our home

Who:
            Tupac & Trevon Leahy
            Hunter Reed

What:
            Hunter called Tupac on his cell phone and told him to come outside.  Tupac and Trevon both came outside and were shot at by Hunter with his new Airsoft Sniper Rifle while Hunter hid.  By the time I came outside Hunter was already a block away and I called the police in part to report the incident while making it clear to them it was not a real gun.

Result:
  • Police arrived within minutes.
  • Officer investigated and I explained we had previously had no luck getting Hunter’s father or stepmother to respond when he acted out so please intervene and make sure that rifle is not going to be used like this again however they could.

Tactic:
            Ambush style shooting might have been a “joke” but in poor taste and risk to all the kids involved.

School response:
            None as this was not a school incident but I made the AMS staff aware of what happened in case problems continued on the next day when school returned.

Police response:
  • Investigated, went to the parents home, Airsoft gun was taken away.
  • Was not referred to youth court
  • Was not prosecuted


3) “Glasses Stolen”

When:
            January 2010

Where:
            AMS blacktop during lunch.  Tupac had been taking a makeup test after being sick and came to lunch late.

Who:
  • Tupac
  • Nicholas Mitchell
  • Liah Kitchen
  • Angel Shaw
  • Hunter Reed
  • Another child

What:
  • Tupac was talking with Liah she took his glasses
  • Liah gave them to Angel
  • Angel claims he never knew he had them but that is not believable based on the other children’s stories/versions
  • Hunter & another friend ran off shortly after that some suspect with Tupac’s glasses

Result:
  • Tupac’s glasses are a special prescription and take 4 weeks to get made at an out of state lab with a cost of $400+ each.  The actual lens prescription changes so often it is not affordable to keep an extra pair at this point.  He is functionally blind without the latest prescription.
  • When he does not have glasses he is forced to wear his sports goggles and that makes him a further target for teasing.
  • Glasses were missing for the weekend.
  • No kids ever owned up to being the last person who had them.
  • Glasses were found on the following Monday destroyed and missing lenses.
  • Hunter’s non-custodial mother drove 60 miles to take him to our home to apologize that weekend and Hunter told Tupac he was sorry this had happened (i.e. not accepting any part of the situation).
  • Later Angel’s mother contacted me (after I demanded he be disciplined as well) to say her son was innocent but he never apologized to Tupac.
           
Tactic:
            Teasing until they get a response.  In this case, Tupac did not overact physically – he sought help after being unable to resolve the situation.

School response:
  • Did not call the police.
  • Did not hold all the kids involved together until glasses produced & or confession.
  • Did not immediately suspend the kids involved or have parents come to get them
  • Only after I demanded were any children disciplined and even then only the initial child involved in removing them, policy says all children in the chain of custody are equally guilty of theft.

Police response:
  • Police investigation was on Monday/Tuesday after the fact so kids had all weekend to agree to a lie.
  • Police did investigate and follow up with Liah but unsure where they left this issue as Liah has had other prior record. 
  • Police should have turned over the case to the prosecutor as evidence was provided based on online/Facebook that clearly showed guilt.

4) “Lunch Bullying”

When:            
            February 2010

Where:
            AMS Lunch Courtyard

Who:
            Tupac
            Neko
            Lachlan
            Hamzah

What:
            Neko and Hamzah were teasing Lachlan to the point he was crying.  Tupac told Neko & Hamzah to “Back off” and “That’s not cool.”  Neko then pushed Tupac.  Tupac then pushed back.  Then Tupac was pushed again.  Tupac then kicked his skateboard.  Then Neko threw a punch at Tupac and miss.  Then Neko threw another punch and hit Tupac.  Tupac rushed to head butt to push him back.  Then it became an all out fist fight.  Tupac was the only child sent to the office by Mr. Rigney.

Result:
            Tupac did stop another kid from being bullied but he then became a target for their anger.  The situation went out of control. 

Tactic:
            Verbal bullying & teasing  Physical intimidation that then leads to a fight and becomes a “he-said / she-said”

School response:
            Tupac was sent to the office and stayed there for the remainder of the school day.

Police response:
            Not called.


5) “Basketball Theft”

When:
            February 2010 (Possibly February 6)
            Approximately 4PM

Where:
            El Cerrito Plaza near CVS

Who:
            Tupac
            Chepron
            CJ Hunter
            Other friends of CJ

What:
            Tupac and Chephron had just bought some food and were joking about it.  CJ was inside the store and said, “Meet me outside punks.”  CJ then went outside.  There was only one exit so the kids used it.  CJ and friends were waiting outside of the door (they could be seen from the inside).  CJ then followed Tupac and Chepron and tried to talk to them.  CJ wanted to know what they were “laughing at in the store”.  Tupac and Chephron tried to ignore them and kept walking.  CJ & friend caught up to Tupac & Chephron by running and stood in front of them so they could not continue.  That is when they threatened them and said “Give me the basketball”.  Tupac said no and they tried to walk away (still in the Plaza).  CJ and friends then followed them for closely for a block and finally stopped.

Result:
            No one was injured this time.  Basketball was not stolen.  But this incident continues to build the “tension” and Tupac’s status as a target.  Tupac felt that he was only safe because this was a public place and if he yelled people might have noticed.

Tactic:
            Physical intimidation.  Verbal bullying.  Threatened theft of property.

School response:
            None because Tupac did not report this even to his dad.

Police response:
            None because Tupac did not report this even to his dad.


6) “Scheduled Beating”

When:
            Tuesday March 16, approximately 3:15pm

Where:
            AMS Middle School (outside front gate)

Who:
            Tupac
            CJ Hunter
            Malik Parker
            Charles Allen

What:
            ·      Tupac commented “Wow” on a Facebook status post by Gaby Jones
·      Charles Allen and friends proceeded to “hit the drum” i.e. spin Tupac up online with threats and comments.
·      Tupac walked into the trap and showed a lack of maturity to understand these kids were serious.
·      Kids involved then informed other kids about the beat down the day before and during the day using mobile phones and Facebook on mobile phones
·      Tupac was being encouraged to fight be a group of “friends” actually most of the kids involved in stealing and destroying his glasses.
·      He was being physically moved to the site of the fight by these “friends” and other kids gathering to see the fight.  He was clear he did not want to be beaten up but others did not listen.
·      The office was informed of the impending attack as Tupac was being somewhat forcibly taken to the site.
·      Tupac was sent to the office and school staff told the kids to disperse and leave the property.
·      I was called and arrived and there was still a group of 5-7 kids from the High School prepared to attack Tupac.
·      Those kids would not leave or respond to school staff commands to the school property.
·      Police arrived and walking into the situation did not really seem prepared to step in.  I had to request an escort to the car – we needed a show of force as the kids were still milling around trying to intimidate Tupac.
·      Even outside on the sidewalk these kids refused to leave property with the police officer there and school staff demanding it.

Result:
  • Tupac received online threats
  • Tupac had in person treats
  • Tupac continues to receive online threats again after the incident “was over”
  • Tupac continues to be physically intimidated by these kids

Tactic:
This group of kids for years target and provoke other students / “wind up” students specifically special needs studets so that they can then claim a “he said-she said” when it becomes violent.

School response (so far):
  • Stopped the incident only after they were told it was impending
  • Were unable to handle the situation i.e. ensure Tupac’s safety as the perpetrators & friends remained on the scene
  • It was reported to me by school staff that even with the limited number of cameras around AMS the one that was closest to where the incident was taking place is not working/recording.
  • AMS reported this to AHS and supposedly one student was brought down to AMS for an investigation.  No word on suspensions under bullying let alone the continued threats.
  • I went to file a uniform complaint against the district yesterday under the new state bullying code but the Superintendent asked that I first complete this step (summary) so that they can see if the middle school and high school staff have been downplaying or following policy for this and past events.
  • Summarizing what has happened for the record and to publish this so that the wider community can take a deeper look.

Police response:
  • Since the fight was averted luckily this time, police at that moment could not do much other than recommend he find a group of friends willing to help protect him and keep him safe from these kids that want to severely injure him.

7) Yesterday

When:
            Tuesday March 17

Where:
            AMS Middle School (outside front gate)

            Tupac

What:

            When I returned home about 1PM before going to AMS to pickup Tupac, I found the items on our porch had been tossed around and it looked like someone was trying to find a key to get inside.  This may or may not be related by the timing is suspicious.

            Tupac waited in the office at AMS for me to be in place to be able to video tape if there were any further incidents as the issue of police reporting and evidence continues to come up over and over again.  When I arrived and walked Tupac out of the gate a nearby car filled with at least AHS students was there and they stared me down and decided to leave instead of what looked like carry out their plan to jump out and attack Tupac.  There were no other AHS kids on the street that I could see at that time.


Result:
  • Again no physical harm but continued intimidation.

Tactic:
  • Veiled threats and becoming even more planned in a possible attack.

School response:
  • Ask the question did you report this to the police?

Police response:
  • Cannot investigate either as no theft, damage or violence was involved.

  1. Arrived at AMS after a Dr. Appointment in the morning.
  2. Lunch started at 12:30pm on Friday 8, 2010.
  3. Went to Room Mr. Place’s room to complete a Science Lab instead of going to lunch.
  4. Left Mr. Places room at 1:00PM and went to get lunch.
  5. Ate lunch with Nicholas Mitchell and his friends sitting down at the tables outside.
  6. Put trays away.
  7. I went over to hang out with Liah Kitchen and Rhiannon Kelly.
  8. They started joking about my name but you did not get upset.
  9. Liah then took my glasses and then asked for them back telling her, “I can’t get new ones until August.”
  10. Liah started teasing that she did not have them.
  11. Liah went over to Christina Reyes and tried to give her the glasses.
  12. Christina said no.
  13. Liah went over to Angel Shah and gave him the glasses.
  14. I went to talk with Nicholas and then went to find Liah.
  15. Liah was running away from me as I tried to find her.
  16. Liah went over near Angel.
  17. Liah, Angel and Hunter were together. 
  18. I asked for my glasses back then Liah said Angel had them.
  19.  I asked Angel for my glasses back and he said he did not have them.
  20. I asked him a second time and Angle said he did not know what I was talking about.
  21. I went to Mr. Neumann – he was near the lunch counter.
  22. I told him Liah took my glasses.
  23. Mr. Neumann had me go to the office and sit down.
  24. Mr. Neumann made them look for the glasses while I had to stay in the office.
  25. Mr. Neumann came back and said that they could not find them.
  26. I was late for PE.
